1. About These Terms
These Terms ("Terms") govern your use of the Feelin Well platform at feelinwell.co (the "Platform"), operated by Full Circle Design (Sole Trader), trading as Feelin Well.
By using the Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Platform.
2. Definitions
- "User" — anyone accessing the Platform
- "Business User" — anyone who registers a business listing
- "Listing" — a business profile published on the Platform
- "Content" — text, images, data submitted to the Platform
3. Eligibility
You must be at least 16 to use the Platform.
4. Account Registration
- Provide accurate, complete and current information
- Keep your login credentials secure
- Notify us of any unauthorised access
- You are responsible for all activity under your account
5. Business Listings
5.1 Submission
Listings are subject to review and approval. We reserve the right to reject, modify or remove any listing.
5.2 Accuracy and Contact Details
Business Users are solely responsible for the accuracy of their listing. Contact details submitted will be publicly displayed to enable customer enquiries.
5.3 Claiming a Listing
Where a listing has been created from publicly available data, the rightful owner may claim ownership. We may require proof of ownership.
5.4 Prohibited Listings
You must not submit listings that are false, misleading, infringing, illegal, or harmful.
6. Data Protection and Privacy
Our handling of personal data is governed by our Privacy Policy, which forms part of these Terms.
7. User Conduct
You agree not to:
- Use the Platform for any unlawful purpose
- Submit spam or false enquiries
- Attempt unauthorised access
- Scrape or harvest data without consent
- Upload viruses or harmful code
- Impersonate any person or entity
- Interfere with the Platform's operation
8. Intellectual Property
All Platform content (excluding user submissions) is the property of Full Circle Design or its licensors. By submitting content, you grant us a non-exclusive, worldwide, royalty-free licence to use, display and distribute that content in connection with the Platform. You retain ownership.
9. Payments
- Prices are displayed in the applicable currency and include VAT where required
- Payments are processed through our third-party payment processor
- We reserve the right to change pricing with reasonable notice
9.1 Subscription Plans
Standard plan: €15/month. Premium plan: €25/month. New business listings receive 6 months free on the Standard plan.
9.2 Cancellation
You may cancel your subscription at any time from your business dashboard. Cancellations take effect at the end of the current billing period.
9.3 Refunds
Refund requests will be considered on a case-by-case basis. Send refund requests to support@feelinwell.co within 14 days of payment.
9.4 Consumer Rights
Consumers in Ireland and the UK may have statutory cancellation rights under the Consumer Rights Act 2015 (UK) or the European Communities (Consumer Information, Cancellation and Other Rights) Regulations 2013 (Ireland).
10. Third-Party Links and Services
The Platform may link to third-party services. We are not responsible for their content or privacy practices.
11. Disclaimers
The Platform is provided "as is". We do not guarantee uninterrupted availability. We act as a directory and do not endorse listed businesses. Any engagement with a listed business is at your own risk.
12. Prohibited Use — Automated Access and Data Scraping
You may not access, collect, index, or use any content, data, or information from the Feelin Well platform by automated means including but not limited to web scrapers, bots, crawlers, spiders, data mining tools, or any other automated extraction technology, without the prior written consent of Feelin Well.
You may not use any automated system to access the platform in a manner that sends more requests to our servers in a given period of time than a human can reasonably produce in the same period using a conventional web browser.
You may not reproduce, republish, distribute, or commercially exploit any listing data, business information, event data, job listings, user data, or any other content sourced from Feelin Well without explicit written permission.
Any attempt to circumvent technical measures implemented by Feelin Well to prevent unauthorised automated access — including but not limited to rate limiting, CAPTCHA systems, IP filtering, or bot detection — is strictly prohibited.
Feelin Well reserves the right to block, suspend, or permanently ban any IP address, user account, or entity found to be in violation of this section, and to pursue any and all legal remedies available under Irish and UK law, including the Computer Misuse Act 1990, the EU Directive on the Legal Protection of Databases (96/9/EC), and the GDPR.
Legitimate use of the Feelin Well platform for personal, non-commercial purposes by individual human users is not affected by this section.
13. Limitation of Liability
To the maximum extent permitted by law, our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim, or €100, whichever is greater. Nothing limits liability for death or personal injury caused by negligence or fraud. Your statutory consumer rights are not affected.
14. Indemnification
You agree to indemnify Full Circle Design from claims arising from your use of the Platform or violation of these Terms.
15. Termination
We may suspend or terminate your access for breach of these Terms. You may request a copy of your data by emailing support@feelinwell.co.
16. Governing Law
These Terms are governed by the laws of the Republic of Ireland. Disputes shall be subject to the exclusive jurisdiction of the Irish courts, without prejudice to mandatory consumer protections in the UK.
17. Changes
We may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be notified to registered users by email.
